Primium CMBS Delivery Company Terms and Conditions

Welcome to Primium CMBS Delivery Company. By utilizing our shipping and delivery services, you agree to the following Terms and Conditions. Please read them carefully, as they establish important guidelines governing our relationship with you.

  1. Definitions

    • Primium CMBS: Refers to Primium CMBS Delivery Company, its subsidiaries, affiliates, and employees.
    • Customer: Refers to any individual or entity using Primium CMBS’s services.
    • Shipment: Refers to any package, parcel, or item that Primium CMBS has agreed to transport for the Customer.
    • Consignment: Refers to the collection of items intended for shipment under one unique tracking reference number.

  2. Prohibited and Restricted Items

  3. Certain items are restricted or prohibited for shipment under applicable laws, including but not limited to:

    • Hazardous materials, chemicals, or explosives
    • Firearms, ammunition, or weapons
    • Perishable goods without prior arrangements
    • Currency, precious metals, or valuable documents
    • Illegal drugs, narcotics, or any controlled substances
    • Animals or biological materials

    Customers must confirm their shipment complies with all restrictions. If unsure, please contact Primium CMBS before shipping. Shipments containing prohibited items may be refused, delayed, or confiscated.

  4. Agreement to Terms

  5. By using Primium CMBS’s services, you acknowledge and agree to the terms and conditions outlined here. This agreement is binding and supersedes any prior agreements, understandings, or representations. Customers must review these terms periodically, as Primium CMBS reserves the right to update them at any time.

  6. Customs and Regulatory Compliance

  7. Primium CMBS Delivery handles shipments globally and adheres to all applicable customs and regulatory requirements. Customers are responsible for:

    • Providing accurate documentation, such as invoices and permits
    • Paying any duties, taxes, or fees imposed by customs authorities
    • Complying with all export/import laws and regulations of the originating and destination countries

    Primium CMBS reserves the right to open and inspect any shipment if required by law.

  8. Packaging and Labeling

  9. Customers are responsible for ensuring that shipments are properly packaged to prevent damage. Packaging must:

    • Be suitable for transportation based on weight, size, and nature of the item
    • Clearly display the full address of the recipient and sender
    • Conform to any additional Primium CMBS guidelines for special shipments

    Primium CMBS is not liable for damages resulting from inadequate packaging. Fragile, valuable, or high-risk items should be packaged according to Primium CMBS’s specific recommendations to avoid damage.

  10. Rates, Billing, and Payments

  11. Shipping rates are determined by the dimensions, weight, destination, and selected service of the shipment. All charges are calculated based on the greater of actual weight or dimensional weight.

    • Billing: Customers may be billed per shipment or on a monthly basis, based on their account agreements.
    • Payment: Payment is due according to the selected service and may be paid by credit card, bank transfer, or another approved method.
    • Non-Payment: Unpaid invoices may result in service suspension and legal action. Additional fees may apply for late payments.

    Rates are subject to change, and any additional charges incurred due to adjustments (e.g., customs fees) will be added to the Customer's account.

  12. Liability and Limitation of Claims

    • General Liability: Primium CMBS’s liability for loss, damage, or delay is limited to the declared value of the shipment or the amount specified by applicable international conventions or local laws.
    • Limits of Coverage: For most shipments, Primium CMBS limits liability to $100 USD unless additional insurance is purchased.
    • Exclusions: Primium CMBS is not liable for damages due to packaging errors, delays caused by customs, natural disasters, or any force majeure events.

    Claims must be filed within 30 days of delivery. Claims for loss or damage must be supported by appropriate documentation, including proof of value.

  13. Insurance Options

  14. Customers may opt to purchase additional insurance coverage for high-value shipments. The availability and cost of additional insurance depend on the nature, value, and destination of the shipment. Primium CMBS’s liability is limited to the declared insurance amount. Customers are encouraged to confirm coverage limits when shipping valuable items.

  15. Delivery and Transit Times

  16. Primium CMBS strives to deliver shipments on time but cannot guarantee specific delivery dates or times. Estimated delivery times may vary based on:

    • Destination
    • Customs and regulatory requirements
    • Weather, political, or transportation disruptions

    No liability is assumed for any delays beyond our control. Customers are encouraged to use tracking options to monitor their shipments in real-time.

  17. Insurance Options

  18. Customers may opt to purchase additional insurance coverage for high-value shipments. The availability and cost of additional insurance depend on the nature, value, and destination of the shipment. Primium CMBS’s liability is limited to the declared insurance amount. Customers are encouraged to confirm coverage limits when shipping valuable items.

  19. Returns and Undeliverable Shipments

  20. If a shipment cannot be delivered to the recipient:

    • Primium CMBS will attempt to contact the Customer to arrange for alternative delivery options.
    • If the shipment is undeliverable or refused, the Customer will be responsible for any return fees or additional charges.

    Shipments may be returned to the sender if undeliverable due to incorrect address information or non-compliance with customs requirements.

  21. Claims Process

  22. For claims related to loss, damage, or delay, the following process applies:

    • Notification: Notify Primium CMBS within 30 days of delivery or the expected delivery date.
    • Documentation: Provide proof of shipment, declared value, and supporting documents.
    • Investigation: Primium CMBS will investigate the claim and determine liability within 90 days.

    If Primium CMBS is found liable, reimbursement will be issued based on the declared value or insurance amount.

  23. Privacy and Data Security

  24. Primium CMBS is committed to protecting your personal information. We comply with data protection laws and only collect information necessary for processing shipments and fulfilling regulatory obligations. Customer information may be shared with third-party vendors for customs clearance, delivery, or billing purposes. For further details, please review our Privacy Policy.

  25. Termination of Service

  26. Primium CMBS reserves the right to terminate services at any time, including cases of:

    • Non-compliance with terms and conditions
    • Fraudulent activity or misuse of services
    • Non-payment or outstanding invoices

    Termination does not exempt the Customer from paying any outstanding charges owed to Primium CMBS.

  27. Governing Law and Jurisdiction

  28. These terms and conditions are governed by the laws of The United States. Any disputes arising from these terms or related to Primium CMBS services shall be settled in the courts of the United States.
